The wedding business continues to reel from allegations claiming the business is laden with unscrupulous practices by vendors who up-sell clients and qualify their pockets by the very car they pull up with. An ongoing poll shows 2/3 of replies says there is good and bad in the wedding industry, just like any other business. 22% feel strong enough to say the wedding business is not crooked, while 12% say it is crooked.

eWedNewz digs deeper in the weeks and months ahead to expose possible causes for the allegations including wedding marketers who teach the art of deception to vendors entering the business. Members of the Wedding Water Cooler continue to give their insight to the story.

The American Bridal and Prom Industry Association, ABPIA, announced a new creative campaign to help retailers fend off the growing problem of online piracy and sale of inferior wedding dresses to American consumers. Steve Lang, president of the group, outlined the campaign and how his fight using all available legal means is starting to have an impact.

ABPIA Launches New Ad Campaign | Invites The Wedding Industry to Unite

After a week of divisive controversy that besmirched the reputation of the wedding business, President of the ABPIA, American Bridal and Prom Industry Association, Steve Lang, decided it’s time to start uniting instead of dividing. Lang watched the controversy from the sidelines while quietly implementing necessary checkpoints and roadblocks to help his part of the business; gowns.

A new Creative Ad by the ABPIA unveiled this week will help rally wedding boutiques and bridal stores to help the fight against internet piracy.

The path to the current information is well-documented thanks to Lang’s outstanding job of keeping this newZ source informed with updates for the public but equally as important, behind-the-scene background so we could fully understand the story.

Here is the latest update from Lang and the ABPIA:

It is with great pleasure to report to you today as President of the American Bridal and Prom Industry Association (ABPIA) our progress fighting counterfeiters from China. At the end of 2012, the ABPIA filed a lawsuit against 45 of the most egregious websites shipping counterfeit merchandise to North America and the rest of the world. The court granted us a temporary restraining order, also referred to as TRO. We returned to court in New Jersey on January 7, 2013 and appeared before the Honorable Judge Wolfson, Chief Magistrate of the Federal Court.

At this hearing, we presented original and counterfeit merchandise from multiple manufacturers and highlighted the damage done to our industry from these offshore pirates. We explained to the judge that approximately 500,000 to 600,000 counterfeit units entered North America in 2012, representing approximately $300 million in lost retail sales. This translates to approximately 100 to 150 units per full-service bridal and social occasion store in the United States.

Within a half hour of testimony, the judge immediately grasped the danger to our industry and ordered the following:

• The granting of a Formal Injunction against the defendant websites to immediately cease and desist from their illegal cyber- squatting activity. Our counsel prepared the paperwork and the order was signed the next day on January 8, 2013.

• For counsel to additionally serve the injunction on all members of the supply chain that aid and abet the counterfeiters. This includes website providers and hosts such as VeriSign, Go-Daddy and other such entities, search engines such as Google, financial entities transferring funds offshore such as PayPal, American Express, MasterCard, Visa, Discover, etc., freight entities transporting goods such as FedEx, UPS, DHL, and any other entity within the supply chain that helps the counterfeiters.

• For counsel to immediately add additional websites as defendants without having to file formal motions to amend the complaint. We have a list of approximately 2,500 additional websites that will be added to the injunction as defendants this week.

• For counsel to instruct all entities conducting business with the counterfeiters to reveal the exact name of the owners of the website, their locations and any other information we feel pertinent in eradicating this threat to the industry. This will aid us in securing damages, shutting down the websites and aiding the court and government agencies to enforce rulings.

• To immediately inform United States Customs and Homeland Security of the injunction to secure maximum help from these institutions to seize illegal websites and counterfeit merchandise.

The judge was clear in her instruction that should any entity fail to comply with the order, she is fully prepared to take additional action. This could include forcing any of these organizations to appear before her in court for rulings, especially if she feels they are in contempt of court.

Judge Wolfson was also clear that the economic damage to the industry is so difficult to calculate that she would place it in the category of “irreparable harm”. The significance of this category is that we could potentially go after large damages from any of the entities should they fail to comply.

It is my great pleasure to report that PayPal has begun to seize funds originally slated to be sent offshore and that we already received notifications of websites that are being shut down by web hosts following instructions of the court order. We expect many more websites to be shuttered over the coming weeks and will remain vigilant in this effort as we add an additional 2,500 counterfeiters to the injunction.

Attached to this email is the ad creative our marketing team recently developed to communicate the ABPIA’s message to the masses. Keep an eye out for this impactful new ad campaign to appear in major publications, websites and social media platforms next season.

Thus far, the ABPIA is comprised of approximately 400 members including manufacturers, retailers, sales representatives, apparel marts, media resources and other interested constituents of our industry. If you have not yet joined the ABPIA, we respectfully feel it is your responsibility to stand up and be counted. Join us in the fight to save our industry from this horrible scourge. We created ABPIA as a nonprofit 501(c) 6 organization, which allows us to lobby in Washington, D.C. and with other government entities. We plan to visit senators and congressmen to secure federal legislation that would give us even greater leverage against these counterfeiters.

It goes without saying that this grand endeavor takes time and money. I have personally dedicated the last year and a half of my life to working on this project, basically turning my company over to be run by my wonderful employees. However, I cannot do this alone and need your help. Attached is an application to join the organization. As you can see, it is only $100 annually for retailers. American Bridal and Prom Industry Association Victory Makes Top Newz

Since winning a temporary injunction newZ of the ABPIA’s efforts quickly spread across all channels of wedding industry sources giving industry members renewed hope that the fight against online piracy can be curtailed. eWedNewz has learned since the economic decline Chinese sources who made wedding dresses for industry manufacturers built factories to service the nearly 2.5 million annual weddings in the United States. But since the economic decline,  lessening need for formal gowns and greater competition for the shrinking market the real manufacturers– makers– of the gowns have gone direct to consumers, bypassing their American partners.

 

Kathy Ireland used her star power to re-tweet the story, driving awareness to the perils of ordering knock-off wedding dresses online.

 

“The true victims are the consumers; they’re the ones who are getting stressed out before the wedding because the products offered are most-times inferior  When they get the items they’re difficult, if not impossible to alter properly. More times than not there is no recourse for them when they try to contact the source of the dress,” according to Steve Lang, owner of Mon Cheri and president of the ABPIA.

Lang’s efforts are slowly but surely impacting the market, reversing some of the troubles by raising awareness. His approach of hitting the pirates from all legal, financial and transporting angles seems to be working. The latest court win is the next step towards a permanent injunction to make all copying and reproduction  illegal.

In a separate story eWedNewz is investigation unfilled pledges and smaller amounts than originally promised given by some of Lang’s supporters. But for the moment the war on piracy continues to ramp up and the win makes top newZ.

In an ongoing poll 25% of respondents so-far say the chances of beating online piracy are poor or impossible. Over 73% say chances are at least fair to excellent. The positive responses were driven up by the latest developments and court order.

Owner of a Major Dress Manufacturing Company Addresses Allegations

After a trip visiting factories in China, Steve Lang, owner of Mon Cheri, gave eWedNewz an update on the war against wedding websites and the growing loss of revenue to piracy and knock-off products. Since the March declaration of war Lang’s efforts has raised nearly $500,000 in hard cash and commitments from wedding-related organizations, including rivals and critics that are unified by the off-shore assault and lost revenue.

 

No good deed goes uncriticized. Steve Lang was forced to discuss unfounded allegations while building a system to help wedding gown retailers.

 

In an eWedNewz interview Lang admits the sale of prom gowns was challenged this season.

“Thank God our sales in wedding-related products is way up to cover what we missed in proms,” he told eWedNewz.

According to Lang’s estimate the US market lost over a half million sales to illegal transactions between American consumers and direct sales from China. The staggering number submitted by Lang contradicts an ongoing eWedNewz poll that shows 59% of respondents would be in favor of spending a little bit more for American-made products. Overall 84% would pay more or care about where products are made. Only 16% say it doesn’t matter where products are made or don’t care.

During the interview Lang says there is a new organization to help the wedding industry on the horizon. Details and finishing touches will be shared in the weeks ahead, along with other significant information.

eWedNewz asked why updates weren’t as frequent and non-existent towards the end of his trip. Lang said he was advised by his legal counsel not to tip-off critics sullied by angst or give them cause for any misinterpretation of the facts. Lang said he feels the perpetrators are closely watching everything that’s being said while a strategy that aligns with recent court victories get set to be deployed.

eWedNewz directly asked Lang whether his company is engaged in any direct sale of either knock-off or first quality Mon Cheri brand products.

In reply to direct questions involving any wrong-doing Lang fired back the following statement in the Wedding Water Cooler forum:

“No one here sells directly to consumers other than a stray personal for a family or friend. Each of those instances needs to be approved by me.

Sounds like someone is attempting to make trouble. Fair warning. If you know me, you know I will give the shirt off my back to you if you are in need of help.  By the same token, be advised that if you idly make allegations that are false, you do not want to be in the same universe with me.”

Discussions and hard-core questions with Lang nearly floored the man who eats, breathes and lives the wedding business. In every communication Lang categorically denies any action that would ever hurt any of his accounts. Lang pointed out how his worst enemies and critics embrace the ongoing efforts.

In addition, Lang’s company was a victim of piracy during his trip. Lang answered all questions and  consistently stayed on point during the interview. In an almost monotone voice he said:

“Even Wen Wu, whom I’ve sued, gave money to this cause, need I say more?” asks Lang.

Several times throughout the grilling Lang, known for his litigious tendencies, emphatically cautioned the sources of the unsubstantiated allegations.

Fellow esteemed members of the Wedding industry and Water Cooler privately contacted this newZ source, asking what was happening. Jim Duhe said the following in the forum:

“I seriously doubt that Steve is personally responsible for a pipeline of gowns direct to consumers.  It would be counterproductive for him to spend his own time and money to combat this problem if he was a source or one of the sources.I’d be shocked to discover that any of Steve Lang’s staff is a party to selling gowns directly to consumers, either.

I’m certain that Steve would discharge anyone immediately if this kind of activity were discovered.  The Mon Cheri staff is like family.  This kind of business would be the same as biting the hand that feeds you.  This isn’t to say that it “couldn’t” happen but it’s highly unlikely that it would happen.

Frankly, I don’t see what purpose is served by accusing Steve or his staff of this kind of activity.  It diverts attention away from the real problem of curtailing the culprits who are responsible for pirating images and selling gowns direct from factories.”

In a telephone conversation after Duhe’s written reply he told eWedNewz, “If Steve was behind it, it wouldn’t be such a mess that it is; it would be done right and never discovered– that’s why I know it’s false. Whatever he does, he does in exemplary fashion.”

The Week of April 9th in Review

Views about formal weddings continue to relax and accept how today’s couples no longer want limits on how they plan their events or what they wear. Ceilings are raised and rules are broken, as couples look for balance between do it yourself and doing it right.

Brides magazine gets set for a highly anticipated makeover while the world wonders if they can turn sagging sales around.

Specific  issues involving China’s growing move to steal ideas and customers from American manufacturers this week shows no one is safe from the thievery. Steve Lang, the head of the campaign, found out his company was a victim. Mon Cheri Bridal images and information wear featured on another website; unauthorized of course.

eWedNewz continues to watch the contradiction between a current poll that says Americans prefer to pay a bit more for products made in the United States and support for lower-priced goods made in China.

Unprecedented Meeting in New York tries to Unify Wedding Industry

Yesterday’s meeting in New York attended by all major media publications was called an unprecedented event, bringing together competing companies to all work for a common cause. The meeting was part of the ongoing efforts led by Steve Lang of Mon Cheri Bridals. Lang announced he was waging war against Chinese pirates who steal designs, make knock off copies and sell direct to American consumers in March. In less than a month Lang has garnered support from major manufacturers, media and a growing list of accomplishments that may very well put a dent in the assault in this country.

For the first time in history major members of the wedding media came together to support Steve Lang’s effort of fighting off foreign thieves.

 

Esteemed media members of the wedding business including Stephanie Nicolet of the Knot, Jim Duhe of Bridal GuideLinda Korman of Hearst CorporationAmy P. Wilkins Martha Stewart Weddings, Chike Kwobu of Munaluchi Bridal, and representatives from Brides among others attended the meeting.

Duhe told eWedNewz, “This was an unprecedented event; where all the major publications were all in the same room and are working together for a common cause.”

Dollars and pledged support for Lang’s move to unify the wedding industry– not just the dress business– is being met with growing interest.

 ”I am please to  tell everyone that in three short weeks we have raised $almost $120,000 in cash  and $250,000 in media support.  A $370,000 war chest,” reported Lang.

In a follow up telephone call Lang told eWedNewz of future plans to create an organization that would include manufacturers, workers, sales help and all other segments of the wedding business, providing health care options and better programs for American workers in the wedding business. But Lang says his immediate focus is to make it as difficult as possible for Chinese pirates to do business.

 

Lang spoke in a clear, concise tone, valuing each opinion in New York and Chicago. Lang is leaving on a month-long mission to visit his factories in China to inspect and demand full coöperation in the fight against piracy.

 

In an update Lang said he is meeting with more shipping, financial and political figures who have been supportive.

“We’re getting to the people we need to get to and they’re sympathetic to what’s happening. They see it, not just in our business but in all businesses. This country is under attack, I am convinced of that. This is the only feasible way we can fight these people,” he told eWedNewz.

At the meeting Lang outlined the plan in a consistent, easy to understand way. Throughout the coverage, Lang builds on solid foundation, led by legal standards of operation. He told the gathering proper channels require documentation and cited a recent court ruling in favor of True Religion.

“In my follow-up and meetings being planned, everyone is aware of what happened at True Religion. With that ruling the right channels are listening a lot closer because now they can act and not just be sympathetic,” said Lang.

In today’s follow up to the meeting Lang told eWedNewz how he regrets having to throw one of his colleagues under the bus. Calling Larry Warshaw of Justin Alexander a distraction, Lang says he feels bad for the man.

“I had to warn the people in that room of the attacks and had to put him (Warshaw) on notice with my legal team. Not only are his remarks made against me slanderous, it’s not good for the industry and wanted to be sure they all knew about it. I feel sorry for the guy,” said Lang.

Other members at the meeting told eWedNewz they support Lang, breathing a sigh of relief that finally, something is being done that you can see, feel and understand. Some even took a swipe at the IBMA calling the group an ambiguous bunch that have done nothing throughout their entire existence.

Lack of leadership at the IBMA organization was denounced by several members of yesterday’s meeting wanting to know why they don’t hand over a larger part of the fund they’re holding to support Lang’s campaign. The organization reportedly offered a token donation but has so far not forked over a dime.

Lang told the gathering he’s expending his own resources to get the movement up and running and was proud to announce not a single penny of monies collected has been spent. In his most recent update, Lang reiterated what he said at the meeting:

“Final comment—NOT ONE PENNY HAS BEEN SPENT…ALL LEGAL WORK HAS BEEN ABSORBED SO FAR BY COUNSEL AND NO FEES WILL BE INCURRED UNTIL WE HAVE A PLAN IN PLACE READY TO EXECUTE.”

True Religion Wins Battle in the war against Chinese Pirates

Apparel Maker True Religion  won a $864-million court judgment against online Chinese counterfeiters in an escalating battle that has no end. In an ongoing eWedNewz investigation counterfeiting continues to suck the life out of American profits and productivity with (lack of) laws that favor the criminals, hinder manufacturers and are basically unenforceable.

 

True Religion wins a battle against Chinese copy cats, sending a message and target of where they can kiss.

 

According to the Los Angeles Times story  a New York federal judge handed down a default judgment shutting down offending websites. Each defendant was ordered to pay $8.15 million dollars as part of the ruling General counsel for True Religion said the websites were probably part of large counterfeiting networks run by “organized crime factors” in China.

The fight against the faceless flock of poachers was recently taken up by American wedding dress manufacturers, led by Steve Lang of Mon Cheri. Lang waged war last month after years of indecisiveness where  other organizations dragged their feet, holding on to funds and not deploying the money to fight the pirates.

After the ruling Lang issued the follow statement:

“The award was huge—a record setting $869 million verdict as 106 different  defendants were hit with damages of $8.15 million each, and were all fined on 4 counts of willful trademark infringement, which carries the statutory  penalty of $2 million each, and a fifth charge of copyright infringement carrying the maximum penalty of $150,000.

This will hopefully  lead to a court issuing an exclusionary order that will instruct US Customs and Border Protection seize and destroy  arriving products that infringe.

Chief counsel for TR Jeans, Deborah Greaves, states that , “we no longer have to chase our tails over 286 bogus web sites and we are pleased we are able to send a message to people operating on the fringes of the electronic frontier. It is important that we will not have US consumers targets of these bogus sites and being duped into buying copies,” according to Lang.

Chicago Bridal Market still the Strongest Show to date

An eWedNewz watch over bridal markets continues to notice Chicago as the strongest of all shows to date. The March 2012  market spotlighted more than 400 lines offered by over 120 vendors, led by the most important bridal resources including recent new entries to the industry.

 

 

According to reports retail activity was healthy with buyers from all over the country in attendance.  Mon Cheri, Allure, Mori Lee, Casablanca, Maggie Sottero, Essence, Bel Aire, Eden, Mary’s, Impression reported good activity and actual sales. Some told eWedNewz it was the strongest Fall Market in years.

Discussions with manufacturers and retailers feel the healthiest companies will continue to support and attend shows that earn their business. In plain and simple terms the strong will get stronger and the weak will die.

Warshaw Outburst called Rickshaw Driven

An outburst by Larry Warshaw pointing the finger  at Steve Lang as a loose cannon sent reverberation throughout the wedding dress business. Lang declared war on websites that pirate American designs and products, selling cheap designs to consumers, causing disruption to the American market.

The unexpected outburst from Warshaw was the culmination of frustration shown by email exchanges alluding to an ambiguous plan in place he feels is now impeded by Lang’s campaign. According to Warshaw Lang should give up his fight and fold into his plan that begun months earlier. According to sources Warshaw has taken a new direction apart from the IBMA that reportedly has $250,000 dollars in the till that needs to be spent.

 

Warshaw-Rickshaw? Too many inconsistencies raise questions to why Warshaw decided to act on his own and why the IBMA president, Alan Dessy, remains invisible.

 

Lang told eWedNewz he became frustrated and tired of waiting for the board to act.

“They’ve dragged their feet for years now, while the industry is in serious peril from these off-shore forces,” according to Lang.

Lang told eWedNewz he’s frustrated again at Warshaw’s decision to blast him and cause further confusion at a very serious time in the wedding dress business.

Lang’s efforts have already raised nearly $100,000 dollars in pledges and commitments to help unify the business and fight against the assault. He’s adequately kept the business informed of how contacts in the United States will be leveraged to fend off the attacks and cut off funds through financial institutions.

According to a growing number of sources Lang’s plan makes the most sense– more than Warshaw’s. Some of the worst critics begin to suspect hidden agendas alleging the aid and abetting of foreign companies. But, as a whole, the majority of sources say they’re in favor of all sides combining to fight off the problems in a unified way.

Sal Macaluso of eFashionCentral.com gave the following statement in reply to recent eWedNewz coverage;

Larry Warshaw’s idea of resolving the problem was a good one, but it pales under the efforts that Steve Lang has instigated.  Until Steve stepped up and coordinated a concerted (and expensive!) effort Larry’s idea might have been the best way to go; it is clearly no longer the best plan on the table.

Unfortunately, their efforts are mutually exclusive.  Larry’s idea was to catch the factories red handed, Steve’s idea is to stop them cold; I ask you, whose idea is better?  Of course it is Steve’s.

The more effective that Steve’s plan is in stopping the recalcitrant factories from shipping “out the back door” the less effective Larry’s efforts will be to catch those factories that would have been shipping “out the back door” if they did not know that there were efforts in place to stop them.  I can see why Larry is upset.  Larry is quoted on your website (from an email that he sent to Steve) as saying, “You are damaging the efforts and research we are doing overseas.” He is absolutely correct when he says that Steve’s efforts are thwarting his efforts, but to what end?  To institute a more effective plan!

I truly hope that Larry and all of the IBMA board members will rethink the wisdom of their strategy and consider putting their support behind this new plan.  There is no question that this is now the best option on the table; it’s really as simple as that.  It’s unfortunate that Larry and Steve have other baggage; nonetheless, I hope for the sake of the industry, that Larry and the other IBMA members will be willing to let bygones be bygones and get onboard with this new more effective strategy.”

eWedNewz has learned there is no love lost between Macaluso and Lang, showing further that although Lang’s grandstanding approach to self-promotion is loathed by many, he’s still regarded as a man who cleans up well and knows how to get things done. For critics to support Lang speaks volumes.
